Note on Data Transfer to the USA and Other Third Countries

We use tools from companies based in the USA or other third countries that do not offer an adequate level of data protection. Where these tools are active, your personal data may be transferred to and processed in these third countries. We draw your attention to the fact that no level of data protection comparable to that in the EU can be guaranteed in these countries. For example, US companies are required to disclose personal data to security authorities without you, as the data subject, being able to take legal action against this. It cannot therefore be ruled out that US authorities (e.g. intelligence agencies) may process, analyse, and permanently store your data located on US servers for surveillance purposes. We have no influence over these processing activities.

Withdrawal of Your Consent to Data Processing

Many data processing operations are only possible with your express consent. You may withdraw consent already given at any time. The lawfulness of the data processing carried out prior to the withdrawal remains unaffected by the withdrawal.

Right to Object to Data Collection in Special Cases and to Direct Marketing (Art. 21 GDPR)

WHERE DATA PROCESSING IS BASED ON ART. 6 PARA. 1 LIT. E OR F GDPR, YOU HAVE THE RIGHT, AT ANY TIME, TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU LODGE AN OBJECTION, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21 PARA. 1 GDPR).

WHERE YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS CONNECTED WITH SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR DIRECT MARKETING PURPOSES (OBJECTION PURSUANT TO ART. 21 PARA. 2 GDPR).

Right to Lodge a Complaint with the Competent Supervisory Authority

In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work, or the place of the alleged infringement. The right to lodge a complaint exists without prejudice to any other administrative or judicial remedy.

Right to Data Portability

You have the right to receive data that we process automatically on the basis of your consent or in performance of a contract in a commonly used, machine-readable format, for yourself or for transfer to a third party. Where you request the direct transfer of the data to another controller, this will only be done insofar as it is technically feasible.

Access, Erasure, and Rectification

Within the scope of applicable statutory provisions, you have the right at any time to receive free information about your stored personal data, its origin and recipients, and the purpose of the data processing, and, if applicable, the right to rectify or delete this data. You may contact us at any time with regard to this and other questions relating to personal data.

Right to Restriction of Processing

You have the right to request the restriction of the processing of your personal data. You may contact us at any time to exercise this right. The right to restriction of processing applies in the following cases:

– If you dispute the accuracy of your personal data stored with us, we generally need time to verify this. For the duration of the review, you have the right to request that the processing of your personal data be restricted.

– If the processing of your personal data is/was unlawful, you may request the restriction of data processing instead of erasure.

– If we no longer need your personal data but you require it for the establishment, exercise, or defence of legal claims, you have the right to request the restriction of processing instead of erasure.

– If you have lodged an objection pursuant to Art. 21 para. 1 GDPR, a balance must be struck between your interests and ours. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

Where the processing of your personal data has been restricted, such data may – apart from being stored – only be processed with your consent or for the establishment, exercise, or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.

SSL/TLS Encryption

For security reasons and to protect the transmission of confidential content, such as orders or enquiries that you send to us as the website operator, this site uses SSL/TLS encryption. You can recognise an encrypted connection by the address bar of your browser changing from "http://" to "https://" and by the padlock icon in your browser bar.

When SSL/TLS encryption is active, the data you transmit to us cannot be read by third parties.

4. Data Collection on This Website

Cookies

Our website uses so-called "cookies". Cookies are small data packets that do not cause any damage to your device. They are stored either temporarily for the duration of a session (session cookies) or permanently (persistent cookies) on your device. Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or your web browser automatically deletes them.

In some cases, cookies from third-party companies may also be stored on your device when you visit our site (third-party cookies). These enable us or you to use certain services of the third-party company..

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them (e.g. the shopping cart function or the display of videos). Other cookies are used to analyse user behaviour or to display advertisements.

Cookies that are required for the performance of the electronic communication process, for the provision of certain functions desired by you, or for the optimisation of the website (e.g. cookies for measuring web audiences) (necessary cookies) are stored on the basis of Art. 6 para. 1 lit. f GDPR, unless another legal basis is indicated. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services. Where consent to the storage of cookies and comparable recognition technologies has been requested, processing is carried out exclusively on the basis of this consent (Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG); consent may be revoked at any time.

You can configure your browser to notify you about the setting of cookies and to only accept cookies on a case-by-case basis, to exclude the acceptance of cookies for certain cases or in general, and to activate the automatic deletion of cookies when closing the browser. Disabling cookies may limit the functionality of this website.

Where cookies from third-party companies or for analytical purposes are used, we will inform you separately within this Privacy Policy and, if applicable, request your consent.

Consent with Cookiebot

Our website uses Cookiebot's consent technology to obtain your consent for the storage of certain cookies on your device or for the use of certain technologies and to document this in a data-protection-compliant manner. The provider of this technology is Cybot A/S, Havnegade 39, 1058 Copenhagen, Denmark (hereinafter "Cookiebot").

When you visit our website, a connection is established with Cookiebot's servers in order to obtain your consents and other declarations regarding cookie use. Cookiebot then stores a cookie in your browser in order to be able to attribute the consents given or their revocation to you. The data collected in this way is stored until you request us to delete it, until you delete the Cookiebot cookie yourself, or until the purpose for which the data is stored no longer applies. Mandatory statutory retention obligations remain unaffected.

Cookiebot is used in order to obtain the legally required consents for the use of cookies. The legal basis for this is Art. 6 para. 1 lit. c GDPR.

Data Processing Agreement

We have concluded a Data Processing Agreement (DPA) with the above-mentioned provider. This is a contract required by data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

Contact Form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provided there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

The processing of this data is carried out on the basis of Art. 6 para. 1 lit. b GDPR, if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of enquiries addressed to us (Art. 6 para. 1 lit. f GDPR) or on your consent (Art. 6 para. 1 lit. a GDPR) if this has been requested; consent may be revoked at any time.

The data you entered in the contact form will remain with us until you request deletion, revoke your consent to storage, or the purpose for which the data is stored no longer applies (e.g. after your enquiry has been fully processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

5. Analytics Tools and Advertising

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistical tools and other technologies on our website. Google Tag Manager itself does not create user profiles, does not store cookies, and does not carry out any independent analyses. It merely manages and serves the tools integrated via it. However, Google Tag Manager does capture your IP address, which may also be transmitted to Google's parent company in the United States.

The use of Google Tag Manager is based on Art. 6 para. 1 lit. f GDPR. The website operator has a legitimate interest in the rapid and uncomplicated integration and management of various tools on its website. Where consent has been requested, processing is carried out exclusively on the basis of Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG, insofar as the consent covers the storage of cookies or access to information on the user's device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent may be revoked at any time.

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. The website operator receives various usage data, such as page views, dwell time, operating systems used, and the origin of the user. This data is attributed to the user's respective device. It is not attributed to a user ID.

Furthermore, Google Analytics allows us to record, among other things, your mouse and scrolling movements and clicks. Google Analytics also uses various modelling approaches to supplement the collected data sets and employs machine learning technologies in data analysis.

Google Analytics uses technologies that enable the recognition of the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is generally transmitted to and stored on a Google server in the USA.

The use of this service is based on your consent pursuant to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG. Consent may be revoked at any time.

Data transfer to the USA is based on the EU Commission's standard contractual clauses. Details can be found here:

IP Anonymisation

We have activated the IP anonymisation function on this website. As a result, your IP address is truncated by Google within Member States of the European Union or in other contracting states of the Agreement on the European Economic Area before transmission to the USA. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity, and to provide other services relating to website use and internet use to the website operator. The IP address transmitted by your browser as part of Google Analytics will not be combined with other data from Google.

Browser Plugin

You can prevent the collection and processing of your data by Google by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en

Further information on how Google Analytics handles user data can be found in Google's Privacy Policy: https://support.google.com/analytics/answer/6004245

Demographic Features in Google Analytics

This website uses the "demographic features" function of Google Analytics in order to be able to display appropriate advertisements to website visitors within the Google advertising network. This allows reports to be generated that contain statements about the age, gender, and interests of site visitors. This data comes from interest-based advertising by Google and from visitor data from third-party providers. This data cannot be attributed to any specific person. You can deactivate this function at any time via the ad settings in your Google account, or you can prohibit the collection of your data by Google Analytics in general as described in the section "Objection to data collection".

Data Processing Agreement

We have concluded a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Facebook Pixel

This website uses the visitor action pixel from Facebook for conversion measurement. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Facebook, however, the data collected is also transferred to the USA and other third countries.

This allows the behaviour of site visitors to be tracked after they have been redirected to the provider's website by clicking on a Facebook advertisement. This enables the effectiveness of Facebook advertisements to be evaluated for statistical and market research purposes and future advertising measures to be optimised.

The data collected is anonymous to us as the operator of this website; we cannot draw conclusions about the identity of users. However, the data is stored and processed by Facebook, which allows a connection to the respective user profile and which Facebook may use for its own advertising purposes in accordance with the Facebook Data Policy (https://www.facebook.com/about/privacy/). This enables Facebook to display advertisements on Facebook pages and outside Facebook. This use of the data cannot be influenced by us as the site operator.

The use of this service is based on your consent pursuant to Art. 6 para. 1 lit. a GDPR and § 25 para. 1 TDDDG. Consent may be revoked at any time.

Data transfer to the USA is based on the EU Commission's standard contractual clauses. Details can be found here:

Insofar as personal data is collected on our website with the aid of the tool described here and forwarded to Facebook, we and Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland are jointly responsible for this data processing (Art. 26 GDPR). The joint responsibility is limited exclusively to the collection of the data and its forwarding to Facebook. The subsequent processing by Facebook is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint processing agreement. The text of the agreement can be found at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the data protection information when using the Facebook tool and for the data-protection-compliant implementation of the tool on our website. Facebook is responsible for the data security of Facebook products. Data subject rights (e.g. requests for information) regarding data processed by Facebook can be asserted directly with Facebook. If you assert data subject rights with us, we are obliged to forward them to Facebook.

You can also deactivate the "Custom Audiences" remarketing function in the ad settings at https://www.facebook.com/ads/preferences/?entry_product=ad_settings_screen. You must be logged in to Facebook to do so. 6. Plugins and Tools

YouTube with Enhanced Data Protection

This website embeds videos from the YouTube website. The operator of the pages is Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

We use YouTube in enhanced data protection mode. According to YouTube, this mode means that YouTube does not store any information about visitors to this website before they watch the video. However, the enhanced data protection mode does not necessarily preclude the transfer of data to YouTube partners. For example, regardless of whether you watch a video, YouTube establishes a connection to the Google DoubleClick network.

As soon as you start a YouTube video on this website, a connection to YouTube's servers is established. The YouTube server is told which of our pages you have visited. If you are logged into your YouTube account, you enable YouTube to assign your browsing behaviour directly to your personal profile. You can prevent this by logging out of your YouTube account.

Furthermore, after starting a video, YouTube may store various cookies on your device or use comparable recognition technologies (e.g. device fingerprinting). In this way YouTube can receive information about visitors to this website. This information is used, among other things, to compile video statistics, to improve user-friendliness, and to prevent fraud attempts.

Further data processing operations may be triggered after the start of a YouTube video, over which we have no control.

YouTube is used in the interest of an appealing presentation of our online offerings. This constitutes a legitimate interest within the meaning of Art. 6 para. 1 lit. f GDPR.

Further information on data protection at YouTube can be found in their Privacy Policy at: https://policies.google.com/privacy

Data Processing Agreement

We have concluded a Data Processing Agreement (DPA) with the above-mentioned provider. This is a contract required by data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

7. Our Own Services

Processing of Applicant Data

We offer you the opportunity to apply to us (e.g. by email, by post, or via an online application form). Below we inform you about the scope, purpose, and use of your personal data collected during the application process. We assure you that the collection, processing, and use of your data will be carried out in accordance with applicable data protection law and all other statutory provisions and that your data will be treated with strict confidentiality.

Scope and Purpose of Data Collection

If you submit an application to us, we process your associated personal data (e.g. contact and communication data, application documents, notes made during interviews, etc.) to the extent necessary for a decision on the establishment of an employment relationship. The legal basis for this is § 26 BDSG under German law (initiation of an employment relationship), Art. 6 para. 1 lit. b GDPR (general pre-contractual engagement), and – where you have given consent – Art. 6 para. 1 lit. a GDPR. Consent may be revoked at any time. Your personal data will only be passed on within our company to persons who are involved in processing your application.

If the application is successful, the data submitted by you will be stored in our data processing systems for the purpose of implementing the employment relationship on the basis of § 26 BDSG and Art. 6 para. 1 lit. b GDPR.

Data Retention Period

If we are unable to make you a job offer, if you decline a job offer, or if you withdraw your application, we reserve the right to retain the data you have transmitted on the basis of our legitimate interests (Art. 6 para. 1 lit. f GDPR) for up to 6 months from the end of the application process (rejection or withdrawal of the application). The data will then be deleted and the physical application documents destroyed. Retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the expiry of the 6-month period (e.g. due to an imminent or pending legal dispute), deletion will not take place until the purpose for the continued retention ceases to apply.

Longer retention may also take place if you have given the appropriate consent (Art. 6 para. 1 lit. a GDPR) or if statutory retention obligations preclude deletion.

Inclusion in the Applicant Pool

If we are unable to make you a job offer, there may be an opportunity to include you in our applicant pool. If you are accepted, all documents and information from your application will be transferred to the applicant pool so that we can contact you in the event of suitable vacancies.

Inclusion in the applicant pool takes place exclusively on the basis of your express consent (Art. 6 para. 1 lit. a GDPR). The giving of consent is voluntary and is not connected with the current application process. The data subject may revoke their consent at any time. In that case, the data will be irrevocably deleted from the applicant pool, unless statutory retention reasons exist. The data in the applicant pool will be irrevocably deleted no later than two years after consent was given.
